SHOVE Terms of Service

1. License

We grant you a limited, personal, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control, for your own non-commercial entertainment, subject to these Terms and the rules of the app store you downloaded it from.

2. Eligibility

The App is intended for a general audience and is not directed at children under 13. If you are under the age of majority where you live, you may use the App only with the involvement of a parent or guardian.

3. Your Account and Display Name

The App does not require registration. It creates an anonymous identifier on your device so your progress and leaderboard entry stay yours. You are responsible for activity that occurs through your device and identifier.

If you join the leaderboard, you may choose a public display name. You are responsible for the name you choose.

4. Acceptable Use and Content

We have zero tolerance for objectionable content and abusive behavior. When using the App, including when choosing a display name, you agree not to:

• use content that is offensive, hateful, harassing, sexually explicit, threatening, or otherwise objectionable;
• impersonate any person or organization, or infringe anyone's rights;
• submit false, manipulated, or cheated scores, or interfere with the App, its backend, or other players;
• attempt to reverse engineer, decompile, or gain unauthorized access to the App or our systems, except where such restriction is prohibited by law.

We may remove any display name or leaderboard entry, and may block a player, at our discretion and without notice, if we believe these Terms have been violated. To report an objectionable name or an abusive player, email [email protected]. We act on credible reports promptly, typically within 24 hours.

By submitting a display name, you grant us a worldwide, royalty-free license to display it in connection with leaderboards and related features of the App.

5. Virtual Items

The App may include virtual coins, themes, patterns, titles, avatar frames, and other virtual items. These items have no monetary value, cannot be exchanged for real money or goods, and are licensed, not sold, to you for use within the App. We may manage, modify, or remove virtual items, and we may change how they are earned or priced, at any time. Virtual items are non-transferable except through features we may provide.

6. Purchases

If in-app purchases are offered, they are sold and processed by the app store you use (for example, the Apple App Store), subject to that store's terms and refund policies. We do not process or store your payment details. Except where required by law or the applicable store's policy, purchases are non-refundable.

7. Availability and Changes

We may update, change, suspend, or discontinue the App or any feature at any time. We are not liable to you for any modification, suspension, or discontinuation of the App or your progress.

8. Disclaimers

The App is provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error free, or that data (including cloud backups and leaderboard entries) will always be preserved.

9. Limitation of Liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, progress, or goodwill, arising from your use of the App. Our total liability for any claim relating to the App will not exceed the greater of the amount you paid us for the App in the 12 months before the claim, or five US dollars.

10. Governing Law

These Terms are governed by the laws applicable at the developer's principal place of business, without regard to conflict of law rules. If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

11. Apple App Store

If you obtained the App from the Apple App Store, you acknowledge that these Terms are between you and Jayvolt only, not Apple, and that Apple is not responsible for the App or its content. Apple's standard Licensed Application End User License Agreement also applies to your use of the App. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

12. Termination

These Terms remain in effect while you use the App. We may suspend or terminate your access if you violate these Terms. You may stop using the App at any time by uninstalling it.
